Terms of service

These Terms of Service ("Terms") govern your use of thewigfairy.com (the "Site") and the products and services offered by The Wig Fairy ("The Wig Fairy," "we," "us," or "our"), including salon appointments, virtual consultations, pop-up events, custom wigs and toppers, and wig services (together, the "Services"). By using the Site or our Services, or by making a purchase, you agree to these Terms. If you do not agree, please do not use the Site or Services.
Our online store is hosted on Shopify Inc., which provides the e-commerce platform we use to sell our products and Services.
1. Eligibility
You must be at least the age of majority in your state of residence to use the Site or purchase from us. Services for a minor must be booked and paid for by a parent or legal guardian, who agrees to these Terms on the minor's behalf.
2. Appointments and consultations
In-salon appointments are by appointment only; we do not accept walk-ins. Virtual consultations and pop-up appointments are booked through our Site. Applicable fees and rules are shown at the time of booking.
Consultation fees, service booking fees, deposits, and pop-up deposit and cancellation terms are described on our Returns & Exchanges page and form part of these Terms.
3. Products, custom orders, and pricing
We make every effort to display product colors and images accurately, but we cannot guarantee that your screen displays colors exactly. Many of our wigs and toppers are custom-made or customized for you; timelines given at consultation are estimates. Prices and product availability may change without notice, and we may limit quantities or discontinue products at any time.
4. Orders, payment, and billing
We may refuse or cancel any order, or limit quantities per person, household, or order. If we change or cancel an order, we will try to contact you using the email, phone number, or address you provided. You agree to provide current, complete, and accurate purchase and account information and to update it as needed. Payments are processed by our payment providers; installment options, where offered, are subject to the provider's own terms.
5. Shipping, returns, and refunds
Shipping, returns, exchanges, and refunds are governed by our Shipping Policy, Refund Policy, and Returns & Exchanges page.
6. Accuracy of information
Content on the Site is provided for general information and may not always be complete or current. We may correct errors, inaccuracies, or omissions, including in pricing, promotions, and availability, at any time, including after you have placed an order.
7. Third-party tools and links
The Site may link to or include tools from third parties, such as booking, payment, and financing providers. We do not control and are not responsible for third-party sites or tools, and your use of them is subject to their terms.
8. Your submissions
If you send us comments, ideas, photos, reviews, or other materials, you confirm that they do not violate anyone's rights and are not unlawful or abusive. We will not publish your photos or personal story without your permission.
9. Personal information
Your personal information is governed by our Privacy Policy.
10. Prohibited uses
You may not use the Site or Services for any unlawful purpose; to infringe intellectual property rights; to harass, abuse, or discriminate against others; to submit false or misleading information; to upload malicious code; to collect others' personal information; to spam, phish, or scrape; or to interfere with the Site's security.
11. Disclaimer and limitation of liability
The Site and Services are provided "as is" and "as available" without warranties of any kind, except as expressly stated by us or required by law. To the fullest extent permitted by law, The Wig Fairy and its owners, employees, and service providers are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or Services. Some states do not allow these limitations, so they may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless The Wig Fairy and its owners, employees, and service providers from claims, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or third-party rights.
13. Severability
If any part of these Terms is found unenforceable, it will be enforced to the fullest extent permitted, and the rest of these Terms will remain in effect.
14. Termination
We may suspend or end your access to the Site or Services if you violate these Terms. Obligations incurred before termination survive it.
15. Entire agreement
These Terms, together with the policies linked here, are the entire agreement between you and The Wig Fairy about the Site and Services. Our failure to enforce any provision is not a waiver.
16. Governing law
These Terms are governed by the laws of the State of California and applicable laws of the United States.
17. Changes to these Terms
We may update these Terms by posting a new version on this page with a new effective date. Continued use of the Site or Services after changes are posted means you accept them.
18. SMS / text messaging terms
The Wig Fairy offers a text messaging program for customers and prospective customers. By providing your mobile number and checking an SMS consent box on our website forms, online booking pages, website chat, or at checkout, or by texting us, you agree to receive text messages from The Wig Fairy at the number provided.
Types of messages:
- Non-marketing messages: appointment confirmations and reminders, consultation and service follow-ups, order and shipping updates, responses to your inquiries, review requests, and customer care messages.
- Marketing messages (only if you separately opt in): promotions, special offers, new arrivals, and pop-up event announcements.
Message frequency varies. Message and data rates may apply. Consent to receive text messages is not a condition of purchase.
To opt out, reply STOP to any message, or tell us in any other reasonable way. You will receive one confirmation message and no further messages unless you opt in again. For help, reply HELP or contact us at info@thewigfairy.com or (310) 800-7475.
Wireless carriers are not liable for delayed or undelivered messages. If we change the phone number used for our messaging program, we will notify you.
We do not share mobile numbers or SMS opt-in data with third parties or affiliates for marketing purposes. See our Privacy Policy for details.
